Due to developer Silicon Knight’s legal battle with Epic Games earlier this year – over a breach in their Unreal Engine license agreement – a ruling has found that all unsold copies of Too Human, X-Men: Destiny and other games made on Unreal software must be destroyed, entirely at the studio’s expense. The case was taken to court in May, with Silicon Knights ruled to owe Epic $4.45 million in damages. Documented evidence of the charge (specifically the 41st page, which deals with the aforementioned recall) was first discovered by a NeoGAF user.
According to the document, Silicon Knights is to destroy all unsold games using Unreal Engine by December 10th, 2012, just under a month away. They are also to cease production, and destroy all of the game code for these games, which include:
- Too Human
- X-Men: Destiny
- The Sandman
- The Box/Ritualyst
- Siren in the Maelstrom
